1. Definitions

In these Terms, unless the context requires otherwise, the following definitions apply:

  • "Alanthic," "we," "us," or "our" means Alanthic Technologies Private Limited, incorporated in India, owner and operator of the Platform at alanthic.com.
  • "Platform" means the website alanthic.com and all associated pages, mobile applications, APIs, SDKs, and tools operated by Alanthic.
  • "Services" means all AI-powered photo shoot generation, product photography creation, virtual model photography, background generation and replacement, brand visual creation, and all related features available through the Platform.
  • "User," "you," or "your" means any individual or legal entity that registers, accesses, or uses the Platform.
  • "Generated Content" or "Assets" means any images, photographs, visuals, or other digital output created through your use of the AI Services.
  • "Input Content" means any product images, photographs, text prompts, brand assets, or other data you upload or submit to the Platform.
  • "Account" means your registered user account on the Platform.
  • "Plan" means your active subscription tier: Free, Starter, Growth, or Enterprise.
  • "Credits" means the usage units consumed per image generation or feature invocation on the Platform.

2. Acceptance & Eligibility

By accessing or using the Platform in any manner, you agree to these Terms. You represent and warrant that:

  • You are at least 18 years of age, or have obtained verifiable parental or guardian consent where required under applicable law.
  • You have the full legal capacity and authority to enter into a binding contract with Alanthic.
  • If accepting on behalf of a company or entity, you have the authority to bind that entity to these Terms.
  • Your use of the Platform will comply with all applicable Indian laws, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and Consumer Protection (E-Commerce) Rules, 2020.

Alanthic reserves the right to refuse access to any individual or entity at its sole discretion, without notice or liability.

3. Account Registration & Security

To access the Services, you must create an Account. You agree to:

  • Provide accurate, truthful, and complete registration information and keep it current at all times.
  • Maintain the confidentiality and security of your login credentials, passwords, and API keys.
  • Not share, transfer, or sell your Account to any other person or entity.
  • Notify Alanthic immediately at support@alanthic.com upon becoming aware of any actual or suspected unauthorised access to your Account.
  • Accept full responsibility for all activities conducted under your Account, whether or not authorised by you.

Alanthic reserves the right to suspend or terminate your Account if any registration information is found to be inaccurate or in violation of these Terms.

4. Subscription Plans, Credits & Billing

4.1 Available Plans

Alanthic offers four subscription tiers:

  • Free Plan: Limited monthly credits for evaluating the Platform.
  • Starter Plan: Paid entry-level subscription with enhanced credits.
  • Growth Plan: Mid-tier paid subscription with high-volume credits.
  • Enterprise Plan: High credits and priority processing, and dedicated support.

4.2 Credits

Each image generation, background replacement, model photography render, or other AI operation on the Platform consumes Credits as specified in your Plan. Unused Credits at the end of a billing cycle are forfeited and do not roll over, unless otherwise specified in your Plan documentation.

4.3 Billing & Payment

  • Paid Plans are billed on credit basis. High Plans are offered at a discounted rate as displayed on the pricing page.
  • All fees are in Indian Rupees (INR) unless otherwise agreed for Enterprise clients. GST and applicable Indian taxes are charged additionally.
  • Plan upgrades take effect immediately and are prorated. Plan downgrades take effect at the next billing cycle.
  • Alanthic reserves the right to modify pricing with a minimum of 30 days' prior written notice.

4.4 Cancellations & Refunds

  • You may cancel your subscription at any time through your Account settings. Access continues until the end of the current paid billing period.
  • All fees are non-refundable except as required by applicable Indian consumer protection law. Refund requests are considered on a case-by-case basis at Alanthic's sole discretion.
  • Upon cancellation, unused Credits are forfeited and are non-transferable.

5. Acceptable Use Policy

5.1 Permitted Uses

You may use the Services to generate AI-powered product photography, virtual model imagery, brand visuals, and marketing content for lawful commercial and personal purposes in accordance with the licence granted under your active Plan.

5.2 Prohibited Uses

You agree that you will NOT use the Platform or Services to:

  • Generate or distribute sexually explicit, obscene, or pornographic content of any kind.
  • Create deepfakes, synthetic media, or misleading AI-generated images of real, identifiable individuals without their explicit written consent.
  • Upload or process images containing minors (persons under 18 years of age) for any purpose.
  • Produce content that harasses, defames, bullies, intimidates, or threatens any person, group, or organisation.
  • Create content promoting, glorifying, or inciting violence, terrorism, self-harm, or extremist ideologies.
  • Generate content that infringes the intellectual property rights of any third party, including copyrighted characters, brand logos, trademarks, or design rights without authorisation.
  • Upload Input Content to which you do not hold full rights or have obtained all necessary licences and consents.
  • Attempt to reverse-engineer, decompile, extract, or reconstruct the AI models, algorithms, weights, training data, or source code of the Platform.
  • Use automated scripts, bots, or scrapers to access the Platform beyond the API usage limits of your Plan.
  • Circumvent, disable, or otherwise interfere with security features, rate limits, credit tracking, or billing mechanisms.
  • Use the Services for any purpose that violates applicable Indian law or international law.

Violations may result in immediate Account suspension or permanent termination without refund, and may be reported to relevant law enforcement authorities.

6. Intellectual Property Rights

6.1 Platform Ownership

The Platform, all AI models, algorithms, software, user interfaces, visual designs, logos, trademarks, and underlying technology are and remain the exclusive intellectual property of Alanthic Technologies Private Limited. Nothing in these Terms transfers any right, title, or interest in the Platform or its technology to you.

6.2 Your Input Content

You retain full ownership of all Input Content you upload. By uploading Input Content, you grant Alanthic a non-exclusive, royalty-free, worldwide licence to process, store, and use your Input Content solely to deliver the Services to you. You warrant that you own or have obtained all necessary rights, licences, and consents for your Input Content, including consents from any identifiable individuals depicted therein.

6.3 AI Output Disclaimer

Alanthic's AI generation technology is inherently variable. We do not guarantee that Generated Content will be unique, identical across multiple generations, or free from similarity to third-party works. You are solely responsible for any intellectual property clearance required before commercially exploiting Generated Content.

7. Privacy & Data

Your personal data is processed in accordance with our Privacy Policy, which is incorporated into these Terms by reference and is compliant with the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000. By using the Platform, you consent to data processing as described in the Privacy Policy.

8. Disclaimers & Limitation of Liability

8.1 As-Is Service

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. ALANTHIC DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8.2 Limitation of Liability

To the maximum extent permitted by applicable Indian law, Alanthic's total aggregate liability for any claim arising from or related to these Terms or the Services shall not exceed the total fees paid by you to Alanthic in the three (3) months immediately preceding the claim. Alanthic is not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, goodwill, or business opportunities.

9. Termination

Alanthic may suspend or terminate your Account and access to the Services immediately and without notice if you breach these Terms, engage in fraudulent activity, or if required by applicable law. Upon termination: your licence to use the Services ceases; unused Credits are forfeited; Alanthic may delete your data per its retention policy; clauses on intellectual property, confidentiality, indemnification, limitation of liability, and governing law survive termination.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Before initiating formal proceedings, parties agree to attempt informal resolution by contacting legal@alanthic.com. If informal resolution fails within 30 days, disputes shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended), with the seat of arbitration in India and proceedings conducted in English. You waive any right to participate in class or representative proceedings.

11. Changes to These Terms

Alanthic reserves the right to modify these Terms at any time. We will provide at least 30 days' prior notice of material changes by posting an updated version on the Platform and notifying registered users by email. Continued use of the Services after the effective date of changes constitutes acceptance of the revised Terms.
